Entry Period: The 5-Hour ENERGY Does The Trick (“Sweepstakes”) will begin on 9/16/25 and end on 10/15/25 (the “Entry Period”).

Who is Eligible:  To enter, you must be a legal resident of the United States or the District of Columbia and be 18 years of age or older or of the age of majority in your state of residence, whichever is older. Employees, officers, directors and agents of Living Essentials, Inc. (“Sponsor”), 5-Hour Energy, The Arena Platform (“Administrator”), Hulett Brothers, and each of their respective parents, affiliated companies, subsidiaries, distributors, participating dealers, retailers, printers, advertising and promotion agencies and any and all other companies associated with the design or execution of this Sweepstakes (collectively, the “Released Parties”), and the members of their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or households, whether or not related, of any of the above, are not eligible to enter or win.  The Sweepstakes is subject to all applicable federal, state and local laws and regulations.  Void where prohibited by law. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram.

How to Enter: During the Entry Period: You must be a follower of the 5-Hour Energy Instagram account (@5Hourenergy) to be eligible. During the entry period, the Hulett Brothers will showcase a new trick shot entrants can recreate at home.  Log in to your Instagram account and post a video on Instagram of yourself properly executing the trick shot, including the hashtags #5HEDoesTheTrick, hulett_brothers, #entry, and #sweepstakes (the “Hashtags”) in your post, to receive one (1) entry. Your Instagram account must be set to public, and your Instagram post must include the Hashtags to be eligible. By using the Hashtags #5HEDoesTheTrick, hulett_brothers, #entry, and #sweepstakes (the “Hashtags”) in your post, you acknowledge and agree that the Sponsor has the right to stream the video post through the Instagram API and/or stream it online at www.5hourenergy.com. Sponsor does not guarantee the video post will be used for either circumstance and may remove a posted video from streaming at any time. In order to enter via Instagram post, you must have a wireless service plan for your web-enabled mobile device with your wireless service provider and a device that supports the Instagram application. Data fees may apply. See your wireless service provider for phone capabilities and fees.

The content of your video and Instagram posts will not be judged and therefore will not increase or decrease your chances of winning. All entries must be received by 11:59 p.m. EST on 6/15/25.  Limit one (1) entries per person. You may only use one (1) Instagram account to enter the Sweepstakes. An Instagram account is required to enter the Sweepstakes, and can be obtained for free at www.instagram.com respectively, or by downloading the respective app from your applicable app store and following the enrollment instructions. Any additional entries submitted from any person or social media account in excess of the above stated limitation will be void. Entries generated by script, macro or other automated means and entries by any means which subvert the entry process will be void.  Entries that are incomplete or corrupted are void and will not be accepted. Mechanical reproductions and entries generated by any means which subvert the entry process are void. Entries that are forged, tampered with, obtained through illegitimate channels or by any other means that are not compliant with the Official Rules will be void.

VIDEO ENTRY REQUIREMENTS: Videos associated with entries, regardless of method of entry, must be (i) entrant’s original creation, (ii) cannot be previously published or submitted in connection with any other promotion, (iii) be in keeping with the Sponsor’s image and (iv) may not contain any content that: is sexually explicit or suggestive; violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane, pornographic, contain nudity, and not be offensive or inappropriate, as determined by the Administrator in its sole discretion; promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group; defames, misrepresents or contains disparaging remarks about other people or companies; contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as personal names or email addresses; nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights, contains copyrighted materials owned by others (including videos, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media); contains materials embodying the names, likenesses, or other indicia identifying any person, including without limitation, celebrities and/or other public or private figures, living or dead, without permission; contains look-alikes of celebrities or other public or private figures, living or dead; communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or violates and law. Administrator reserves the right to void Sweepstakes entries that do not comply with the above entry requirements from Sweepstakes consideration. Noncompliant entries may be removed from the Sweepstakes at Administrator’s sole discretion.

GENERAL CONDITIONS:  Released Parties are not responsible for: (i) electronic transmissions, entries, or  Instagram posts that are lost, late, incomplete, inaccurate, damaged, garbled, misdirected, undelivered, delayed, or not received by the Released Parties or their respective agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or Instagram posts, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed, interrupted or unavailable hardware, network, software, cable, satellite, Internet Service Provider (ISP), or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes, (iv) any other mechanical, technical, printing, typographical, human, or other errors or malfunctions or technical failure, jumbled, scrambled, delayed, or misdirected transmissions relating to or in connection with the Sweepstakes, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Sweepstakes, the processing of entries, or Instagram posts, the announcement of the prizes, or in any Sweepstakes-related materials, or (v) any entries or Instagram posts submitted in a manner that is not expressly allowed under these Official Rules and all such entries will be void. Sponsor reserves the right to cancel, modify or terminate the Sweepstakes in the event that fraud, misconduct, technical failures or other causes destroy or threaten the integrity of the Sweepstakes, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, worm, tampering, unauthorized intervention, or other technical problem or other cause corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination, the Sponsor reserves the right to conduct a random drawing for the prizes from among all eligible, non-suspect entries received up to time of such impairment.  In the event a dispute as to an entry submitted by multiple users having the same Instagram an entry will be deemed made by the authorized account holder of the Instagram account used to submit the applicable Sweepstakes post, and such person will be required to meet the eligibility requirements of these Official Rules. “Authorized account holder” means the natural person who was assigned the applicable Instagram account by Instagram. Any potential winner may be requested to provide proof (to the Released Parties’ satisfaction) that they are the authorized account holder. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Winner Selection & Notification:  Upon the conclusion of Entry Period, the Administrator will select one (1) potential prize winner in a random drawing from all eligible entries that properly completed the trick and used the #hashtags during that Entry over the Sweepstakes.  Odds of winning depend on the number of eligible entries. Potential winners will be contacted by Administrator in one of the following ways: 1) Posting a comment on a potential winner’s Instagram post, which will include Sponsor’s or Administrator’s return contact details within the comment, and potential winner will be required to respond as instructed within twenty-four (24) hours of issuance of notification and provide their contact information; 2) Via Instagram Direct Message, and potential winner will be required to respond as instructed via Direct Message within twenty-four (24) hours of issuance of notification and to provide their contact information. Potential winners are subject to eligibility verification and compliance with these Official Rules. Potential winners may be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within five (5) days of date of issuance. If any prize notification, direct message, post and/or letter is returned as undeliverable, a potential winner cannot be contacted within a reasonable time period, does not reply to correspondence within the required timeframe, fails to comply with verification process and/or eligibility requirements, documents are not returned within the specified time period, or potential winner is not in compliance with these Official Rules, he/she will be disqualified and an alternate winner may be selected at Administrator’s sole discretion from the remaining eligible entries received and notified as per the procedures outlined in these Official Rules. In the event of a dispute as to the identity of the entrant, entrant will be deemed the primary account holder with the Instagram or Twitter account used to enter. Proof to Sponsor satisfaction of being the primary account holder may be required by Sponsor or Administrator.

Prizes: The winner will receive $5,000 cash, awarded in the form of a check (Approximate Retail Value (“ARV”) of Grand Prize: $5,000).

Grand Prize Conditions: Winner is solely responsible for any and all income, federal, state and local taxes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided. Winner may not substitute, assign, or transfer prize, but Administrator reserves the right, at its sole discretion, to substitute a prize with one of comparable or greater value.  All prize details are at Administrator’s sole discretion. The decision of the Administrator in the interpretation of these Official Rules is final.

License/Use Of Entries:  By participating via Instagram, and to the extent allowed by law, you grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse your entry, name, post, video, and biographical material including, but not limited to, all materials submitted in connection with the Sweepstakes in any and all media, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.

Additional Rules & Restrictions:  By participating in this Sweepstakes, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor and the Administrator, which shall be final and binding in all matters relating to this Sweepstakes.  In the event a winner is found to be in violation of any of these Official Rules, he/she will be required to forfeit the awarded prize or to reimburse the Sponsor for the stated value of such prize if such violation is found after the prize has been used by winner.  Acceptance of a prize constitutes permission for Sponsor and its designees to use winner’s name, city and state of residence and/or likeness for purposes of advertising and trade in any and all media now or hereafter known worldwide in perpetuity, without limitation or further compensation, notification or permission, unless prohibited by law.  By participating, each entrant further agrees to release and hold Released Parties harmless from and against any and all claims, damages and liability of any kind arising from or in connection with, in whole or in part, directly or indirectly, the acceptance, possession or use/misuse of a prize (including any activity related thereto), participation in the Sweepstakes or in any prize-related activities and entrants assume all liability in connection therewith.

Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.

Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Michigan, USA.
